Zum Werk Bei den Incoterms® - International Commercial Terms - handelt es sich um eine Reihe von internationalen Regeln zur Definition spezifizierter Handelsbedingungen im Außenhandel. Die elf Drei-Buchstaben-Klauseln regeln die wesentlichen Käufer- und Verkäuferpflichten, insbesondere bei grenzüberschreitenden Geschäften (z.B. fob - free on board). Sie regeln die Kostenverteilung, die Risikoverteilung und die Sorgfaltspflichten zwischen den Vertragspartnern und ermöglichen eine standardisierte Abwicklung von Handelsbeziehungen. Der Vorteil für die Parteien besteht darin, dass Verträge international einheitlich ausgelegt werden. Die Vertragspartner gewinnen Klarheit und Rechtssicherheit über den Vertragsinhalt; kosten- und zeitintensive Rechtsstreitigkeiten werden vermieden. Die Klauseln werden von der privatwirtschaftlich organisierten Internationalen Handelskammer (ICC) herausgegeben und regelmäßig an aktuelle Entwicklungen angepasst. Die Incoterms® werden heute auf internationaler Ebene allgemein anerkannt und von der United Nations Commission on International Trade Law (UNCITRAL) unterstützt. Sie werden auch von den jeweiligen nationalen Gerichten anerkannt. Mittlerweile stehen autorisierte Fassungen der Klauseln in 31 verschiedenen Sprachen zur Verfügung. Allerdings haben sie keinen Gesetzesstatus, d.h. sie müssen in den jeweiligen Vertrag explizit aufgenommen werden, um ihre Gültigkeit zu sichern.
